Terms of Service
Please read these Terms carefully before using michati.com. They set out what the Service is, what you may do with the data it shows, and the limits of our responsibility for it.
1. Acceptance of Terms
These Terms of Service (the “Terms”) are an agreement between you and michati.com (“michati”, “we”, “us”) covering your use of the michati.com website, the market-data pages it serves, and everything else we make available through it (together, the “Service”).
By creating an account, or by using the Service in any other way, you accept these Terms. If you do not accept them, do not use the Service. If you are using the Service for a company or other organisation, you confirm that you are allowed to accept these Terms on its behalf.
2. What the Service Is
michati presents United States residential real-estate market data — price-to-rent ratios, rent levels, and for-sale listing trends — aggregated by ZIP code, county, and metropolitan area, and shown as tables, maps, and time series.
The Service is an informational and research tool. It is not investment, financial, tax, legal, appraisal, or brokerage advice, it is not an offer or solicitation to buy or sell any property or security, and it is not a substitute for your own due diligence or for advice from a qualified professional. Any decision you make on the basis of what you see here is yours alone.
3. About the Data
Market data shown in the Service is obtained from third-party sources and is provided to you as it reaches us. We do not independently verify it, and we do not warrant that it is accurate, complete, current, or fit for any particular purpose. Figures are periodic snapshots and will lag the market.
Derived figures — in particular the price-to-rent ratio — are estimates produced by combining separate datasets whose coverage and definitions do not align perfectly. Where a value is missing at one geographic level, the Service may substitute an estimate derived from a broader level, and it indicates when it has done so. Treat such values as rough indicators rather than precise measurements.
The underlying data remains the property of its respective providers and is made available to you only as part of the Service.
4. Accounts
Most of the Service requires an account. You must provide accurate registration details, verify your email address, and keep your password confidential. You are responsible for everything that happens under your account.
Accounts are personal to you. Do not share your credentials, and do not let anyone else use your account to access the Service. Tell us promptly if you believe your account has been used without your permission.
You must be at least 18 years old, and legally able to enter into a contract, to hold an account.
5. Acceptable Use
You may use the Service to research markets for your own investment or business purposes, and you may keep a reasonable amount of the material you view for your internal use.
You may not: scrape, crawl, or bulk-extract data from the Service, or access it by automated means; republish, redistribute, sell, sublicense, or otherwise make the data available to anyone else, or build a competing or derivative data product from it; circumvent or interfere with authentication, rate limits, or any other technical restriction; probe, overload, or disrupt the Service or the infrastructure it runs on; reverse engineer any part of the Service; or use the Service in breach of applicable law.
6. Fees
The Service is currently offered free of charge. We may introduce paid plans in future; if we do, we will tell you the price and terms before any charge applies, and you will not be billed for a paid plan you have not agreed to.
7. Intellectual Property
The Service — including its software, design, text, charts, maps, and the way the data is compiled and presented — is owned by michati or its licensors and is protected by intellectual property law. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service. No other rights are granted, whether by implication or otherwise.
If you send us feedback or suggestions, we may use them freely and without obligation to you.
8. Availability and Changes to the Service
We may change, suspend, or discontinue any part of the Service, including particular datasets or pages, at any time. We do not promise that the Service will be uninterrupted or error-free, or that any dataset will remain available or continue to be updated.
9. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, if we reasonably suspect misuse of your account or of the data, or if we discontinue the Service.
On termination your right to use the Service ends immediately. Sections that by their nature should survive — including sections 3, 5, 7, 10, 11, and 12 — continue to apply.
10. Disclaimers
The Service and all data in it are provided “as is” and “as available”, without warranty of any kind, whether express, implied, or statutory, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will meet your requirements, or that any result obtained from it will be accurate or reliable.
11. Limitation of Liability
To the fullest extent permitted by law, michati is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, lost investment returns, lost data, or loss of business, arising out of or in connection with your use of the Service — including any decision you take, or refrain from taking, on the basis of data shown in it.
To the fullest extent permitted by law, our total liability arising out of or in connection with these Terms or the Service is limited to the greater of the amount you paid us for the Service in the twelve months before the claim arose, or USD 100.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, and some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.
12. Indemnity
You agree to indemnify and hold michati harmless against claims, losses, and costs (including reasonable legal fees) arising from your use of the Service, your breach of these Terms, or your infringement of the rights of others.
13. Privacy
Our handling of personal data is described in the Privacy Policy, which forms part of these Terms.
14. Changes to These Terms
We may update these Terms from time to time. If a change is material, we will give notice through the Service or by email to the address on your account before it takes effect. Continuing to use the Service after a change takes effect means you accept the updated Terms; if you do not, stop using the Service and close your account.
15. General
These Terms are the entire agreement between you and michati regarding the Service. If any provision is held unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them to a successor of our business.
